About these terms

These terms apply to every quote we issue, every order we accept and your use of https://brcreates.com. “We” and “us” means B & R Creations, Haryana, India. “You” means the business, institution or organisation placing the order, and the person placing it confirms they are authorised to do so.

Our products and services are offered to businesses and organisations for corporate gifting, employee engagement and promotional use. By approving a quote or paying an advance you accept these terms. Where a signed purchase agreement exists between us, that agreement prevails over anything inconsistent here.

Quotes and pricing

• Validity: quotes are valid for 15 days from the date issued. After that, prices may change with raw material, currency and courier rates, and we will reconfirm before accepting the order.
• Per unit, ex-works: prices are per unit, exclusive of GST and shipping, for collection from our premises in Haryana unless the quote says otherwise.
• Branding: standard single-colour, single-position branding is included where the quote says so. Additional colours, positions, digitising, screens, dies or laser jigs are charged as set-up, typically ₹500 to ₹1,500 per design.
• GST: Goods and Services Tax is charged extra at the applicable rate (currently 18% on most branded merchandise) and shown separately on the invoice.
• Tiers: discounts for 50, 100, 500 and 1,000+ units apply to a single product and design in one order and are not combined across orders.
• Prices on the website are indicative ranges. Obvious typographical errors in a quote may be corrected before acceptance.

Orders, advance and payment

• An order is confirmed when we receive your written approval of the mockup and proforma invoice (email or WhatsApp is sufficient) and a 50% advance. Production slots are booked only after both.
• The remaining 50% is payable before dispatch, against the final GST tax invoice. Goods are released once funds are received.
• Payment is by NEFT, RTGS, IMPS, UPI or cheque to the bank account printed on the proforma. We never change bank details over WhatsApp; if you receive such a message, call us to verify before paying.
• Where you deduct TDS, please share the TDS certificate (Form 16A) within the statutory timeline.
• Orders above ₹5,00,000 or repeat clients with agreed credit terms may be offered different payment milestones in writing.

Artwork and approval

• You supply the artwork (vector preferred) and confirm it is accurate, including spelling, colours and legal marks.
• We send a digital mockup showing placement and size. Your written approval of that mockup is final: production follows the approved mockup, not the original files, and we are not liable for errors that appear in the approved version.
• Because branding is applied to physical products, allow a colour variance of up to 10% against screen or Pantone references and a placement tolerance of ±2 mm.
• Physical pre-production samples are available on request and are chargeable; see Samples below.
• Changes requested after approval restart the approval step and may change the price and delivery date.

Made-to-order goods and cancellation

Branded, engraved, embroidered, personalised and custom-packed goods are made exclusively for you and cannot be resold. For that reason:

• Before production starts: you may cancel in writing. We refund the advance within 7 working days, less any set-up costs incurred and any stock already procured specifically for your order.
• After production starts: the order cannot be cancelled. The advance is non-refundable and the balance remains payable for all units completed.
• Unbranded ready-stock items may be cancelled before dispatch without charge.

Production, lead times and delivery

• Lead times are quoted in working days and start from mockup approval and receipt of the advance, whichever is later. Late artwork or approvals extend the date accordingly.
• Branded orders carry a quantity tolerance of ±5%. We invoice the quantity actually delivered within that tolerance.
• Risk in the goods passes to you when they are handed to the courier or collected from our premises. Title passes on receipt of full payment.
• We are not liable for delays caused by events outside our reasonable control, including courier disruption, strikes, floods, government restrictions or raw material shortages. We will tell you promptly and agree a revised date.
• Dispatch, charges and delivery claims are covered in our Shipping & Returns policy, which forms part of these terms.

Samples

Pre-production samples are charged at the 25-unit price plus courier and set-up, and the sample charge is adjusted against a confirmed order of 100 units or more of the same product. Samples are not returnable.

Intellectual property and trademarks

• You confirm you own, or are licensed to use, every logo, trademark and image you ask us to reproduce, and you indemnify us against any third-party claim arising from that artwork.
• Artwork remains yours. Mockup files, product photography and website content we create remain ours.
• We may photograph finished products for our portfolio and social media unless you ask us in writing not to, in which case we will not.

Warranties and liability

• We warrant that goods will match the approved mockup and be free from manufacturing defects on delivery.
• Defects, damage or shortages must be reported within 48 hours of delivery with photographs. Our remedy is, at our option, to replace the affected units or issue a credit for them.
• Our total liability for any order is limited to the amount you have paid for that order. We are not liable for indirect or consequential losses, including loss of profit, event costs or reputational loss.
• Nothing in these terms excludes liability that cannot be excluded under Indian law.

Use of this website

• Website content is for general information. Product images are indicative and availability depends on stock at the time of ordering.
• You may not copy, scrape or reuse our photography, copy or catalogue data without written permission.
• Links to third-party sites are provided for convenience; we are not responsible for their content.

Governing law and jurisdiction

These terms are governed by the laws of India. We will try to resolve any dispute amicably first. Failing that, the courts in Haryana have exclusive jurisdiction, and both parties submit to it.
